These Terms of Service ("Terms") govern your access to and use of the Mustr software, mobile and web applications, and related services (collectively, the "Service"). The Service is operated by Mustr, a K-12 emergency communications platform headquartered in Lansing, Michigan. By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
Mustr is provided to participating school districts as a tool to coordinate emergency response under the "I Love U Guys" Foundation's Standard Response Protocol (SRP) and Standard Reunification Method (SRM). The Service is intended to be used by authorized district staff, not by students or the general public. Mustr is not a substitute for emergency services; in any real emergency you must always call 911 first.
You may use the Service only if (a) you are an employee, contractor, or designated volunteer of a school district that has executed a written subscription with Mustr, and (b) you have been invited and provisioned by an authorized administrator of that district. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that occurs under your account.
Each subscribing school district is the data controller of the records stored in Mustr. Mustr operates as a school official with a legitimate educational interest under 34 CFR §99.31(a)(1)(i)(B) and processes records solely on the district's instructions. The handling of personal data is described in our Privacy Policy, which is incorporated into these Terms.
You agree not to:
The Service deliberately requires a 3-second press-and-hold to trigger a real event so that drills (a regular tap) cannot be confused with an actual emergency. You agree to use these controls as designed and to coordinate every drill with your school's incident commander.
The Service relies on push notifications, in-app banners, and SMS fallback to deliver time-critical alerts. Delivery depends on third-party infrastructure (Apple Push Notification service, Google FCM, Twilio, your wireless carrier, your device's notification settings) which Mustr does not control. You are responsible for ensuring notification permissions are granted on every device you use for emergency response.
SMS program disclosure: By providing your mobile number and consenting during account setup, you agree to receive emergency alert and drill notification text messages from Mustr on behalf of your school district. Message frequency varies and depends on emergency events and drills at your school. Message and data rates may apply. Reply STOP to opt out at any time, HELP for help, or contact support@mustrk12.com. Carriers are not liable for delayed or undelivered messages. See our SMS Terms and Privacy Policy.
Pricing, billing terms, and subscription length are governed by the written subscription agreement between Mustr and your district. The Service is licensed, not sold. We do not charge individual staff for access; if your district's subscription lapses, your account will be deactivated.
Records you create or access through the Service may include education records protected by FERPA and other state laws. You agree to treat all such records as confidential and to disclose them only to persons authorized by your district. You must report any suspected unauthorized access to security@mustrk12.com within 24 hours of discovery.
You may stop using the Service at any time. To request deletion of your individual account and the personal data tied to it, use the self-serve Delete account page or email privacy@mustrk12.com. Mustr will fulfill the request within 30 days, subject to records your district is legally required to retain (audit logs of triggered events, reunification ledger entries, etc.). District-level data deletion is governed by the subscription agreement.
Mustr and its licensors retain all right, title, and interest in the Service, including all software, designs, trademarks, and documentation. The Standard Response Protocol and Standard Reunification Method are the intellectual property of the "I Love U Guys" Foundation; Mustr independently implements those publicly published protocols and is not affiliated with, sponsored by, certified by, or endorsed by the Foundation. SRP and SRM are trademarks of the "I Love U Guys" Foundation.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Mustr does not warrant that the Service will be uninterrupted, error-free, or that notifications will be delivered within any specific time. The Service is not a 911 service and does not summon emergency responders.
To the maximum extent permitted by law, Mustr's aggregate liability arising out of or relating to these Terms or the Service will not exceed the fees paid by your district for the Service in the 12 months preceding the event giving rise to the claim. In no event will Mustr be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
You agree to indemnify and hold harmless Mustr from any third-party claim arising out of (a) your breach of these Terms or (b) your misuse of the Service in violation of your district's policies or applicable law.
We may update these Terms from time to time. Material changes will be communicated to district administrators by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles. Exclusive venue for any dispute lies in the state and federal courts located in Ingham County, Michigan.
